 This is a accommodation for a guy in a female category. Imagine if you did this in other women’s sports. How would you How would that be possible?  This is not a political decision. This is a basketball decision. >> But But they are being prevented from playing on the team that matches their gender identity, correct? >> That’s the effect. So, let me use your example from earlier. You said there’s a cisgender woman, she could play on the team she wants. >> Right. >> There is a boy who identifies as a girl, he can’t play on the team he wants.

Take that same boy and switch his gender identity, but say he still wanted to play on the girls team. Say he was a very unathletic boy. He likewise couldn’t play on the team. So, it’s not the gender identity that’s keeping him off the girls team, it’s his biological sex. His gender identity is wholly irrelevant to it.

 Now, I agree with you, there’s a very significant disparate impact on transgender individuals by this law because they’re the boys who are most likely to want to play >> Having said that Title IX never covers that kind of disparate impact in terms of its discriminatory effect? >> Uh well, it certainly doesn’t cover disparate First of all, I don’t think Title IX covers disparate impact period because it uses >> But in terms of its discriminatory effect, I’m just trying to understand it.

 Is there something to this notion that some that differential treatment in effect in this way could be something that Title IX cares about? >> A, I don’t think Title IX covers disparate impact even on the basis of sex, and it certainly doesn’t cover disparate impact on the basis of gender identity. >> Okay. >> And that basketball decision produced the most ironic possible World Cup storyline.

The genetic message of gender. The genetic message of biological facts. While the WNBA doesn’t know what a woman is, the shirts that reference the XX chromosomes are banned.

 Had a player leave the bench during a live timeout to confront a courtside fan in profanity. >> What does it actually mean to be equal? You know what I mean? Like women are actually equal to men, then there would be no WNBA, would there? You would just be good enough to play in the NBA with us. Or, here’s another idea that’s going to be very controversial, you could shut the [ __ ] up.

And the institutions that make actual policy in women’s sport, the IOC, the NCAA, the WTA, 27 state legislatures have all landed where Cunningham landed, not where Griner landed. >> head coach, Stephanie White, well, she didn’t want biological men kicked out of women’s sports, and she made that pretty clear.

>> I don’t know that I would say that I’m educated enough from a scientific standpoint. Uh, I don’t ever believe that exclusion is an answer. I just don’t. Um, I I do think you know, when we think about various levels of sport, um, various governing bodies of sport, and things that go into that.

 Like I said, I’m not I’m not educated enough at the different levels. Um, I know growing up, I played with the boys all the time. >> The WTA announced biological sex screening for all players. The IOC aligned with that policy ahead of the 2028 games. The NCAA banned transgender women from women’s competitions. >> The bill to keep biological males out of women’s sports fails.

How do you rationalize this? How does this How do you go in front of your people and say, “Yeah, I want I want dudes in women’s locker room.” >> The WNBA’s own CBA says only women are eligible to play and still cannot define what a woman is. >> It’s hard not to think about. Even when I watch sports I’ll be thinking about.

Like like think about Okay, okay, say say LeBron James uh changed his gender. You know what I mean? Okay, can he stay in the NBA or because he’s a woman does he have to go to the WNBA where he will score 840 points a game? >> But every institution that has produced an actual written policy has produced one that agrees with Cunningham.

>> said, “I do think that there is a thing called pretty privilege. There is a thing called white privilege. There is a thing called tall privilege. And we have to acknowledge that. And so um part of it is about race because if you think about the Brittney Griners of the world, you know, why did she have to go to play in Russia?” >> pay her.

Charles Barkley said the WNBA did this to themselves.

 Bill Maher said 80% of the country is where Cunningham is. Stephen A. Smith said do something or suck it up. Joe Rogan said they painted themselves into the most loony position where they cannot define what a woman is. And Greg Gutfeld watches all of it with the expression of a man who saw the punchline coming from the first sentence.
